Under draft laws released by Treasurer Jim Chalmers, existing trusts will be able to avoid the new 30% minimum tax by choosing to make fixed distributions to nominated beneficiaries.
Crucially, they will not have to restructure, avoiding potentially hefty stamp duty bills.
The government has also agreed to exempt distributions to registered charities and allow some donations to sporting.
