What it was is AIA got taken to AFCA, so the Australian Financial Complaints Authority.
So if you have any issues with the insurers, you know, pretty much financial advisors, you go to AFCA and settle the complaint.
AFCA awarded the client the full claim.
Now, what the claim was was for mental health.
Now, what the client didn't disclose was diabetes.
Now, the requirement... So, AIA, when they went and assessed that mental health claim, they noted that there was diabetes.
Yes.
And so...
Now, if it was for mental health, they would have, AFCA would have sided with AIA and said, well, you didn't disclose the mental health and that's a mental health claim.
They're well in their rights to decline that.
But because it was a separate medical event, AIA were arguing, hey, we would have never accepted this.
And they said it was fraudulent non-disclosure, which if it's fraudulent non-disclosure, they can void the contract completely.
So AIA says, you never own the contract.
Here's your premiums back.
Now the client took them to AFCA and AFCA determined that AIA didn't have enough evidence that it was fraudulent non-disclosure because that was the bar for them to void the contract.
So this isn't an endorsement to non-disclose.
Definitely not.
Definitely don't do that.
But it does mean that even if you do get a decline from an insurance company, if they haven't done their due diligence or if they don't provide enough evidence that it was fraudulent non-disclosure,
they still had to pay out the claim.
