Uh it's it's unclear if FIRE understood that they were responsible for the CQA exemption overall or just to review what was given to them by the applicant.
Uh I've heard repeatedly from staff that they are not responsible for fire code review.
And so it would appear to me that it falls to this quasi judicial body to make the determination if the city is in fact able to exempt the A B one hundred checklist.
However, in order to do that, you may want to clarify with staff of the city attorney whether in fact you can deem the application as being incomplete.
Because if you were to send this back
But you do not have the authority to deem the application incomplete.
The clock continues to run and at sixty days the application is approved without a hearing.
So I would urge you to make sure that the land use at me who's on on the video there can give you confirmation whether you have the power to send this back, to remand this back to staff and say the application deemed incomplete and to come back with a more complete application based on the findings from today.

reconsider based on a number of procedural errors that have compounded over time across different councils, different city managers, different city attorneys, and a process that is not the fault of any one party, but a compounding set of failures that I'm going to outline in
In the first failure, the city ran an RFP on public right of way before the vacation was complete.
The RFP was never part of the administrative written record.
It is unclear to this day if the RFP was for a ground lease or for a sale.
It is unclear if the city got a single respondent why the city could not rerun the RFP as it's always done with other projects, including other agencies.
The city then went on to form a parcel before vacation.
Parcel formation presupposes disposition ready property.
