Today was a loss for the American people because by taking away President Trump's instantaneous leverage using the IEPA authority, the American people have suffered a significant setback.
Think to this time last year when President Trump put on the fentanyl tariffs against Mexico, Canada, China for the precursor chemicals.
And then we saw a rapid decline in fentanyl deaths.
If that's not an emergency authority, what was?
Treasury's estimates show that the use of Section 122 authority combined with potentially enhanced Section 232 and Section 301 tariffs will result in virtually unchanged tariff revenue in 2026.
It's in dispute.
Supreme Court did not rule on that today.
They pushed it back down to the International Tax and Trade Court.
And my sense is that could be dragged out for weeks, months, years.
My understanding is that we are going to proceed with the hearings.
Senator Tillis wants to keep a hold on any vote with Kevin Warsh leaving committee, making it to the full Senate.
But I think it's important.
to get the hearings underway, and I think we have an agreement to do that.
