Sorry, not boating, but they go out to the lake with some other kids that were white.
By kids, we're talking 18 to 21-ish.
They go out.
They smoke a little weed.
They're having some drinks, and they convince him to go do a deep dive despite being under the substances.
They're under the substances.
They are horse playing.
They convince him to do the deep dive.
He does the dive, and so do some of them, and they come up just fine, and he don't.
and so then we had to spend time figuring out what exactly went on and the biggest challenge that i found was it took pulling teeth to get to the truth if they thought it they were going to be in legal trouble for it if it was more though if i couched it from his mommy just wants to understand because it's it's impossible for us to start healing from the grief
when it doesn't even make sense because we're sitting, having nightmares of his drowning of this, that, and the third.
And ultimately what we found is there wasn't criminality, but there was negligence.
Dana, I think you're about to describe the harassment more, but I just want to say, as you get into that, the harassment of the mother, when people say this isn't about race, I point to that example.
Because there is no way a mother of a white child who had been drowned with other white kids who simply goes to the media and goes to the police and says, I want to know how my child drowned, would ever be getting doxxed and virtually harassed in one-star reviews trying to make that mom lose her job for simply asking why.
what we've gotten into whereas those kids did something they did something and that may not we don't know right but there could be something where they know something more than they're letting on for now so can you just explain that sure so negligence is a different standard negligence is effectively um acting unreasonably under certain facts where a reasonable person would not have done what you did so just to start on the basics from the facts we do have
It appears that I believe it was Warren was the driver.
It appears that the driver of that boat was toasted.
He was drunk.
so in while being a drunk driver allegedly of the boat if that were the case and there's some facts in the full audio that lean towards that but if if that were true and um nolan ward fell off the boat or risk or hurt himself in some way as a result of the drunk voting that's negligence
That's what and and negligence can be civil or it can be criminal on the criminal side.
