On the civil side, you can simply ask the judge for an instruction to the jury that says, your honor, they destroyed this.
So we are entitled to an inference that they destroyed it because this evidence would have helped us prove our case.
Yes, a negative inference.

If it was a video that showed, let's say it was a video that showed a fight with one of the other boys on the boat and Nolan, then the inference could be that fight was the cause of injuries and that impacted his death.
A jerk.
The jury can just assume that without looking at that evidence because they destroyed the evidence or that that fight then resulted in him falling off the boat, being hit, falling off the boat and was the cause of death.
