Um, Claire, I'm a partner at Fox Rothschild, also in North Carolina.
And my practice is largely healthcare regulatory, but I also work on healthcare litigation matters, uh, defending false claims act investigations.
HIPAA compliance, part two compliance, um, and and a variety of other
uh healthcare related matters.
And uh a large part of my practice um does include HIPAA and part two compliance and
I've recently spent a good bit of time responding to subpoenas with clients and helping them navigate that process.
And I'm really glad to talk to you today about the article that you wrote for AHLA.
I think it's very risky um and because it may not be legally permissible.
Um you might think that if you got a legal document like a subpoena, you have to comply with it.
But this is one circumstance where you really need to stop and think and understand.
What the federal and state regulatory framework is for responding.
Um, under HIPAA and part two that we'll we'll talk about both some today.
Uh there are specific requirements and it's mainly um or often necessary to refuse to comply with a subpoena unless you get the necessary court order or other assurances um about uh the process that was followed before the subpoena was issued.
Um and uh I find oftentimes that the lawyers issuing the subpoenas are in
uh sir uh practice areas and they have no clue about HIPAA or part two, they just send the subpoena because they want the records and then um you have to both educate them and um get the necessary court order before you give up any records.
Right.
It does require a response.
You can't just ignore it.
A provider can't just ignore it.
Okay.
