Just to level set, um, generally speaking, HIPAA sets federal standards for uh privacy of protected health information and we'll call it PHI, I think oh yeah as a term that people everybody knows and uses.
It applies to um
covered entities, which are typically healthcare providers, health plans, and healthcare clearinghouses, and business associates.
And those are defined in the regulations.
I won't go into all of that.
But um
PHI is a very broadly defined term.
It's anything that's individually identifiable and health related, uh if you will.
It's demographic information.
uh the individual's past, present and future health.
care that they received for those health conditions and then payment for
the services provided uh if the payment identifies the individual and most often not just medical records.
Sometimes we take that it's much broader than medical records.
And uh generally speaking it can't be disclosed without patient consent.
Or a court order.
Um there are certain exceptions in HIPAA and I'll mention a few of them.
One of them um and applicable in this context is um permitting disclosure required by law.
And there are certain things like um uh in the context of the emergency department at a hospital, if there's a gunshot wound or certain other injuries.
there's a required reporting uh because uh of there's a potential for a crime.
And so those there are circumstances like that where there are risk exceptions to the general rule.
