Right.
And some abuse and neglect, those sorts of things.
Um so there's per uh in the setting of subpoenas there's
permissible disclosures for judicial administrative proceedings.
And that's, you know, what we're gonna talk more about today.
But the bottom line is for every situation you need to review the requirements carefully because each exception has its own rules and regulations as well.
Um can you before we go further, can you just explain um in kind of plain terms the difference between a court order and a subpoena?
Right.
It's um in practical terms, it's um sati the it's an assurance that the person requesting the records has sought to get in touch with a patient whose records are at issue, has given them um written notice that their records have been requested.
given them uh enough information in the notice that they can have an opportunity to protest or um object to the production of their records, a timeframe for
them to make that objection and then um
No further action until that time frame is elapsed.
The deadline is passed and pursuant to which they either appeared and objected or didn't appear.
uh or uh they've objected and a court has resolved their objections.
But those are the types of
subs uh satisfactory assurances that HEPA requires.
It's a fairly elaborate process, I would say.
And I haven't found um very many circumstances where it's used.
