The OCR uh s publishes its reports of settlements and uh
give statistics about its efforts and in um in recent
months or the last year or so there have been settlements with penalties in cases that involve
improper disclosures that were related to security rule failures, they didn't have adequate safeguards.
to prevent typically it's access um
you know, through a ransomware or other cyber attack.
They weren't doing their could have done a better job to prevent that.
Sometimes it's it it's not possible to prevent, but I think OCR is always gonna say there's something else a provider
could and should have done, um, including um, you know, a faulty risk assessment or a failure to do a risk assessment, that sort of thing.
Uh but there were um failures around breach notices, uh around improper disclosures, like uh you know, I didn't find any specific to subpoena situation.
But uh there was one recent one where there was a disclosure to a news reporter.
by healthcare provider.
Um that certainly seems obviously a problem.
Um and then penalties um
There are
there are penalty structures in terms of uh their ranges of penalties and I I didn't outline those for today's presentation, but
I've seen penalties um
That are small as a few thousand dollars and maybe there was one patient at issue and a small provider.
And then the highest I was able to find was around sixteen million dollars.
