So it's generally um applicable um even if if the provider doesn't accept Medicare or Medicaid for that substance use disorder treatment program.

And the part two rules are really complex, uh, and even more stringent or strict than HIPAA with respect to the confidentiality of the records.

to um to to uh I guess there's a still still quite a bit of stigma attached to

uh that those records and that kind of treatment.

And so the idea is that um you need to treat them even more carefully than you would uh regular physical health care records.

Um there have been some changes to part two in the last couple of years that make them more closely aligned.

with HIPAA and simplify the process of t obtaining consents from patients.

You can obtain now a consent for h uh treatment, payment, and healthcare operations in one

the document where you whereas you did not have that ability in the past.

But there's still a lot of ways in which part two is more strict than HIPAA and has more pitfalls that you could

uh experience as you're trying to navigate compliance.

Um, one thing that we talked about the other day and that's important to understand is that um it prevents a provider from even acknowledging

that a patient was treated at the particular facility.

Um, and is that protective of the patient's identity and uh as well as the patient's records?

So um uh in responding to a subpoena, you you can't um necessarily admit or acknowledge that that person was a patient, but you have to respond and say if that person was a patient.

We would need a court order.

It's always a little awkward when you send that letter.

It's very awkward.
