Court of Appeals for the D.C. Circuit has declined to hear their case, the men now have two choices. Appeal to the country's highest court or continue toward a death penalty trial. The plea deals would have let them plead guilty in return for up to life in prison. They'll now consult with their lawyers about next steps. Sasha Pfeiffer, NPR News.
U.S. futures are flat in after-hours trading on Wall Street. This is NPR. The longest-serving Democrat in Congress says he's retiring at the end of his term. 86-year-old Maryland Democrat Steny Hoyer has been in office since 1981. He served as majority leader twice and once positioned himself as a possible alternative to Speaker Nancy Pelosi.
Hoyer is expected to make an official announcement later today. There will not be a mistrial in the case against a former Uvalde school police officer who is accused of not stopping a mass shooter. Texas Public Radio's David Martin Davies has the story.
Defense attorneys for Adrian Gonzalez asked for a mistrial after a Robb Elementary School teacher testified on Tuesday that she saw a man matching the description of the mass shooter near the area where Gonzalez was. One issue was her testimony contradicted her interview with the Texas Ranger's and her new testimony should have been provided to the defense under the prosecution's discovery.
Judge Sid Harrell said this was negligence and not deliberate and wasn't sufficient to call for a new trial with the new jury. Testimony is expected to continue on Thursday. Gonzalez is accused of child neglect by not confronting the gunman who killed 19 children and two teachers in 2022. I'm David Martin Davies in San Antonio.
