「乗務時間外手当は通常賃金 含めないと最賃割れ 東京地裁」 判別不能で全額が基礎に 運送会社でトラック運転者として働く労働者が、会社に未払い賃金を請求した裁判で、東京地方裁判所（小川弘持裁判官）は「乗務時間外手当」を残業代と認めず、通常の労働時間に対する賃金と判断し、同社に計300万円の支払いを命じた。基本給のスタートを12万5000円としており、そのほかの必ず支払われる手当を足しても、総支給額は最低賃金を下回る可能性があると指摘。
