Uh the next thing is uh we open our hearings with a pledge of allegiance. If everyone stands, we have the flag right there. So um before we start the hearing, this is a public forum, and so because of that, um if is there anyone here who is present who is not here for an appeal who wishes to address the Board of Equalisation. Okay. So Okay. I thought somebody was punking me with raising your hand. Um all right. So Yeah, so that's for us Damon Andrew. All right. So um okay, so welcome to the board. Um I wrote a script because I talk too much sometimes, but um so what'll happen is when we have the the hearing, um first thing is we'll swear in all individuals who are testifying.

Uh they'll be sworn in, so it'll be both the core and the appellant and any any uh witnesses you might have. Um general It's anyone seated at the table who's interacting with the board will be sworn in. The BOE chair, which that's myself, presides over the hearing. So all remarks should be addressed to the board for both parties because the board is making the decision. I'll be managing the hearing, so I'll be paying attention and making sure we're moving it forward. I'll be looking to make sure everybody has an opportunity to speak. So if um you know once we start going through the presentation if you want to say something you know just like raise your hand look at me or you know hey you know I'll I'll look and then I'll I'll acknowledge that uh that I'll get to you.

Yeah. So that's how we'll run the meeting. Um I would I would r um emphasize focus on facts relevant to the real estate assessment under appeal. Um usually it's not a problem, but sometimes it is so I ask I I uh ask that people focus on the facts. Um as far as the order of presentation, so the panel you'll present first. So you present your your uh justification for changing an assessment, then the core will present their facts and and their assessment and where they came up with and then each party will have an opportunity to respond. Again, respond to the board because it's not a a debate between the two parties. It's presenting information. And then board members will ask can ask questions at any time.

I'll be also looking at board members as well. So board members if you want to say something, you know, just wave your hand or something or ask a question. Um at any point in time, a board member may make a motion to act on the appeal. Once a motion is made, only board members speak. Um if a board member has a question for one party in particular, they will ask that question to you, so then you can talk to them, obviously. But once the motion is made, then it's just a discussion between the board. Um Okay, so this is important for you to be aware of. All uh Board of Equalization Appeals begin with the presumption that the core's assessment is correct and that it was developed in accordance with the United Uniform Standards of Professional Appraisal Practice, USPAP.

This presumption by demonstrating one of the two things. One, the property is assessed over over fair market value, and often the discrepancies have to do with physical conditions that weren't identified before. Second, the assessment you have to show that the assessment is not uniform or is not derived using these generally accepted practices. So basically showing that, okay, for similar properties, you guys. Treated them different from us. So that that's what you need to focus on when you're presenting your um your reasoning for uh change.
