Good evening. I'd like to call to order the October 23rd, 2025 Board of Zoning Appeals public hearing. The board is composed of five members and two alternates. Four of us are present tonight. We are a quasi-judicial body and an arm of the court. We meet on the fourth Thursday of each month, unless it's November or December, and after each application has been duly advertised in a local publication for two consecutive weeks, and after each property has been duly posted, and after all adjacent owners have been notified by certified mail. It takes three affirmative votes from this board for a matter to pass the board. If you wish to speak and have not signed up in advance, please sign a piece of paper with our secretary, Stephanie Capps, so your name can be called.
Specifically, I have two I have one that has basically applied to speak in advance of this evening, John Benedict and Denise Roll and a series of others that have had. If anyone else would like to be heard and has not filled out one of these forms, please see miss caps. For each application, we will hear from staff first, then the applicant or their representatives, each of whom will have 10 minutes. Other speakers will have three minutes each. Before we begin, I would like to ask everyone to check their cell phones and ensure that it's silenced or off so that it does not interrupt the proceedings or mess up the audio recording. Thank you. And now I would ask everyone that is intending to speak before the board this evening to rise for swearing.
Do you solemn swear that the testimony you are about to give at this hearing shall be the truth and nothing but the truth? Thank you. Okay. We have a number of issues before us this evening. The initial part of it is a preliminary matter.
Good evening, Board Member Gray and members of the board. My name is Hugh Green. I'm the attorney for the county. There are by my, as of, since the agenda, there are one, two, three, three matters in a housekeeping matter that would be preliminary. And the first is there are two, the first is the landowners have, who are represented by Mr. Randy Minshew and Ms. Anna Ritter are here. They have submitted after the filing the 20-day limit. They're asking leave to file their, their uh supplemental filing in support of loudon county uh as apelli and i'll let um the i'll let the property owner's attorney speak to that but in there as well is a standing issue a standing question so um i'll of course let uh council talk about that as well but how how the court excuse me how the board wants to handle that
The second preliminary matter is that the appellants represented by Mr. Price submitted a filing on October 21st, which may not have gotten your packets, but I believe Ms. Capps, the BZA secretary, has put it before you. That too is late filed. I'm assuming Mr. Price would want leave to have that accepted. I'll let Mr. Price speak to that. And I can talk about the preliminary, I guess the housekeeping matter when we get to the hearing. But those are the, I guess, three that were before you. And I'll let you talk, you know, if you want to bring up the attorneys and let them make their case.

Mr. Minshew. I would ask one thing and just without my hearing aids, I am profoundly deaf. With my hearing aids, I'm moderately profoundly deaf. So if you can just get very close and enunciate, I'd appreciate it. Thank you.
Thank you, Chairman Gray. My name is Randy Minshew. I'm here together with Anaretta Council for the Landowner. Mr. Chairman, I gave my first presentation before the Board of Zoning Appeals of Loudoun County in 1988, and my senior partner, Mr. Bill Chapman, introduced me to the Board at that time, and I would like to do the same thing tonight, introduce to this Board Anna Ritter of our firm. This is her first appearance for the BCA and like Mr. Chapman did for me in 1988, I'd like to yield the floor with your leave and introduce you to Ms. Anna Ritter.
