Are they truly a small business as defined, you know, under the SBA guidelines and eligible for SBA financing?
Um, so they w th so they are really looking at, you know, they want the franchisee
to have the ability to profit from their hard work and, you know, bear the risk of loss and not just be a uh and and have it really be their own company.
not just a glorified employee of the uh franchise or.
Um
one of the things that came up where people were asking about, well, what about steppen rights?
And Step and Rights is when
you know, due to some kind of
dramatic circumstances.
the franchise order does not feel that the franchisee is able to run the business and the franchise order is gonna step in for a management fee.
So that could be, you know, in a situation where there's a uh a disability, you know, franchisee gets hit by a bus
he's in a coma for a month, no one knows what's gonna happen, who's running the business, the franchiseur can step in.
Or there's some kind of egregious mismanagement going on and the franchise or is concerned
And the you know, the SBA was pretty much not going to prevent a franchise over from having these stepping rights.
As long as they weren't permanent and
that they were reevaluating every sixty, ninety days whether these circumstances have changed and giving a uh
opportunity for the franchisee to step back in.
uh
also wanted to make sure that the franchise was controlling their own employees, they were controlling their own money.
