So they don't actually go anywhere.

They just mention the fact that they were found on the floor but nothing was able to be taken from them.

And the defence pick that up and say...

They suggest that the knives are an absolute red herring.

They say the prosecution can't point to a single piece of evidence connecting the knives to the death of Marie.

And the fact is there's just three kitchen knives in a house that was destroyed by fire.

Exactly.

So the defense says if the jury is to find Timothy Loosemore guilty, then they have to agree on by which possibility that happened.

So whether Timothy Loosemore killed Marie Vermont and then lit the fire, or if he seriously injured her, incapacitated her, and then lit the fire that she died in.

And they argue that if medical experts can't tell the jury how she died, then how can they unanimously agree on which way this happened?

So the jury started deliberating on a Friday afternoon and then they actually came back to the court with a question on the Wednesday.

They asked the judge for an elaboration of something he said in his charge to them.

So he's told them that they can only infer that Timothy Loosemore intended to kill Miss Vermont or cause her really serious injury if they are satisfied beyond reasonable doubt that that is the only inference open from the facts that they have found.

And their question is, does that mean the only reasonable inference?

And that's a bit complicated.

It's a lot of words.

Yeah.

But essentially, they're saying, is that the only reasonable inference that they can find, not some, I guess, implausible, you know, option?

And the answer to that is yes.

It is up to them to determine what is reasonable.
