Correct.
But I agree with what Ms.
Schwartz said, that the schedules do reflect the positions on the settlement.
The schedules in the settlement agreement do reflect
COMPANY STATED TODAY AT THE HEARING.
WE AGREE WITH THE 70-30 CAPITAL STRUCTURE AND THE 150 BASIS POINTS ON THE 20-YEAR TREASURY RATE.
Right.
The Commission's jurisdiction is to set rates, not to agree private party agreements between two individuals.
I believe that
Is one potential outcome taking a large customer like this out of the system means that the cost that it requires to serve all customers will be spread over a smaller customer base or usage?
So, yes, it could have potentially negatively impacted JW at HOA 1 withdrawn as a customer and self-supply.
I agree with what Mr. Barasa said.
Hypotheticals have their place in rate making, but it's better to use actuals.
And this does, as Mr. Barasa testified,
move the company towards a more balanced capital structure through a phased approach.
We've seen it with other utilities that had 100% equity, where they've gone to a 70-30% basis first before moving more towards a 40-60 or 60-40.
I don't know that we necessarily know for a fact that the companies could get a better rate if they went to the open market.
We thought, as Ms.
Schwartz testified originally, they had requested a 200 basis point.
We thought a 150 basis point above the 20-year treasury rate was more appropriate and served as a protection for rate payers, given the fact that they're obtaining the debt from the parent.
