But we're both right, I think, that the water has been drained from that glass, and it's concerning.
And it's not a good day for those of us who want to hold this administration in check.
But at the same time, like I said, there is a way around it, and it's been prescribed by the Supreme Court.
Well, it's interesting.
I read Justice Sotomayor's dissent, and she called out the Supreme Court for allowing it to be played.
Because you remember, this issue was about birthright citizenship.
And the administration knew that they would lose on that issue.
They were getting beaten up in the courts on it.
They were losing badly.
And they knew they would lose at the Supreme Court.
So they did not take that on appeal.
This is not an appeal on the stay, the block, of the birthright citizenship issue.
This was an appeal on the narrow issue, which would be a lot more popular at the Supreme Court about...
the uh the use of injunctions and i use the term narrow that's that's actually incorrect just the issue of injunctions not the specific issue of birthright citizenship which tells you which way the court is going to go on that issue but now we're left to deal with the aftermath
Dave, well, you would have a legal challenge in court and you'd see class certification for everyone affected and you'd have to get class certification and then you would seek a nationwide stay based on that class.
It's not clear the procedure.
They, in fact, Justice Barrett, in her opinion, recognize that there could be.
some chaos as different states go different ways and different courts do different things.
But she pretty much said that, well, it'll get sorted out by the appellate courts and we'll see.
But I do think there'll be a lot of stays issue.
