I think as in many areas, people are looking to get the best case they can before the Supreme Court first, the one with the best facts.
You know, the Trump people talk about the Salvadoran case because
the individual in question, Garcia, is alleged to be a member of a terrible gang that nobody can say anything good about.
We don't know what the real facts are, at least I don't.
But what we do know is residents of the country are entitled to a certain amount of due process.
And when the Supreme Court has said facilitate Garcia's return, they mean what they say.
And, you know, it was interesting, Wilkinson's opinion offered
free of charge, a grammar lesson to the attorney general on what the word facilitate means.
I mean, I don't know how you can spell it out any more clearly.
Yeah.
Look, he had, as I understand the facts, he had a suspension of deportation order that an immigration judge had entered some years before.
Now, that that order can be can be changed on the basis of new evidence.
They didn't provide any new evidence.
And I think Wilkinson put it very well in his opinion where they just snatched him without without any without any due process at all.
We don't give due process to people because they're nice.
We give it because they're entitled as residents to due process.
And where it gets hard, as in cases of free speech, is when the people who are claiming due process are not the kind of people you want for your next door neighbor.
But the analogy is like to what Voltaire was once said to have observed about speech.
He said, I don't agree with your opinion, but I will defend to the death your right to express it.
In this case, I don't care how bad this guy is, if he can't get due process, the risk extends to everybody else.
