I think is so terrifying.

You know, I'm sure Don Lemonation is aware of the case of Kilmar Obrego Garcia, the man who was wrongfully expelled to El Salvador based on an administrative error.

He has returned now in the United States where he is facing criminal charges.

A truly horrifying development is he has elected to, he has asked to remain in federal custody before his trial so that he is not at risk of being snatched up by ICE and sent off to some third country.

Because that is what ICE was threatening to do.

How dire is it that we are now in a place where in order to protect your civil rights,

you are trying to stay in detention before your trial and the gross abuses that they are engaged in the number of people they are threatening and we are just six months into the administration i mean i realize that people might look at this and say oh these are naturalized citizens again we are six months in if you think they are not going to try to do the same to anyone right they could potentially disagree with

You are deluding yourself again because they are now trying to deny people birthright citizenship that is guaranteed under the United States Constitution.

So legally, there is this tricky situation where individuals who might be challenging this would be having to navigate.

And that's because immigration is technically considered civil in nature.

Oh, wait, but the GOP loves to say how these are criminal people criminally doing criminal stuff when they come in.

And yet, they often do not try to bring criminal charges where they would actually be required to prove their case beyond a reasonable doubt in courts of law.

So technically, if the administration is just engaged in traditional civil enforcement of immigration law, that is civil in nature.

But I think there is a strong case to be made that the administration is trying to use these conditions to punish people as punitive.

And I think for that reason, we are kind of entering into unchartered legal terrain where there is a very good argument that, again, the administration is targeting people as punishment, subjecting them to these cruel conditions to punish them and targeting them to make an example out of them.

These are all reasons that sound like criminal law.

And therefore, I think individuals challenging this would have a strong argument that this is cruel and unusual punishment in violation of the Eighth Amendment.

Trump doesn't care.

So.

So I would draw a distinction between the Supreme Court and the lower federal courts, because I think thus far, a lot of lower federal courts have understood their job is to apply the law and enforce the law against the administration.
