This is a criminal conspiracy between Todd Blanch and Donald Trump and his lawyers to steal tax dollars and to defraud the American people.
There is simply no legal basis to put this money
in the hands of people who make these settlement claims.
The settlement fund itself is very problematic in the administration because there appears to be no court oversight, no oversight by anybody except for the five people who serve on the fund who are appointed by the Attorney General and can be removed by the President.
There are no guidelines for who they can pay and how much, and there's not even a requirement of public disclosure or
any process for public input into this process.
So this is incredibly problematic and it is really perpetrating a fraud on the American people and a theft of American funds.
There's a couple of different possibilities.
One is that members of Congress could sue to try to block this settlement.
Essentially what the president is doing here is an end run around Congress.
Under the Constitution, only Congress has the legal authority to appropriate funds.
So the proper way to create a settlement commission would be for Congress to allocate the money.
They have not done that here.
And Donald Trump used the pretext of a lawsuit and the settlement of a lawsuit to create this fund that he does not have the legal authority to create.
So members of Congress can sue and make the argument that the president is essentially suing.
stepping on their toes overreaching his constitutional authority by creating this settlement fund.
Another possibility is that individual citizens could potentially file a lawsuit to try to protect their tax dollars.
That is very difficult because
The Supreme Court's case law on the idea of taxpayer standing is very unfavorable to taxpayers who claim that their money is being misspent.
