Australia's Work, Health and Safety Regulator has recommended the Defence Force be prosecuted over a fatal army helicopter crash.
Four officers were killed when their Taipan helicopter crashed into waters off Queensland during a training exercise in July 2023.
An internal investigation found the primary cause of the crash was spatial disorientation, which occurs when a pilot misjudges the position of their aircraft in relation to the surrounding environment.
Federal prosecutors said they would not be launching legal action against Defence last year.
However, government agency Comcare has now handed evidence to the Federal Director of Public Prosecutions relating to safety and fatigue management systems.
Speaking at a parliamentary inquiry on Friday, CEO Colin Radford said Comcare considered there was evidence to support a view that Defence may have committed one or more offences under the Work, Health and Safety Act.
Although a two-year limitation period has expired, Radford noted the Act allows for proceedings to be brought outside that period in specific circumstances.
Inquiries are continuing.
