But yes, you put it through because the court says they must consider it, the best interests of the children.
Yeah.
We're used to that with babies, right?
In the courts, affidavits and things, we talk a lot about the baby's routine and what the baby can have and what the baby can't have and those sorts of things.
But we give up at about two years old or so.
And it's not normal then to be talking about the procedures, whether they have a dummy or not, what time they go to bed, do they have a last day, all that.
We just sort of abandon them then.
And the court wants the children to experience both parents as they are.
That's what the orders, as Judge Bell used to say, warts and all.
I mean, it might seem a little bit of a betrayal of trust, but putting a camera or a recording device in their face, you may need some of that protection because, of course, what's going to happen is you'll be accused of alienating the children if they've formed this view.
But the law used to be that 14-year-old was it.
Whatever they said went, and it's because they can vote with their feet and they can get on the bus and go home or whatever.
And the classic response from certain unenlightened of the judiciary would be, you make them brush your teeth, don't you?
And I wish my clients sometimes would say, yes, but their teeth doesn't belt them or their teeth doesn't sweat.
The toothbrush doesn't swear at them.
It's different.
It's different.
And their wishes are normally followed by the court.
You've got to find some way of getting their wishes into the court or perhaps to present it to the other person.
And it might be a family report where the child can express it in an open environment and the other side presumably will get the message.
