you probably couldn't care less whether they have a tattoo and their boss probably couldn't care less.

Um and also if it's if it's covered up

It also isn't an issue.

Um I actually I know an attorney in another firm who has the the full arm sleeve tattoos, but you know, if he's in court or meeting with clients he's wearing a suit or tie, so again, not an issue.

Where it does become an issue

uh is where you have

uh a position such as a a bank employee, a uh a waiter in a high end restaurant where the open display of of a tattoo or what's also very common a a piercing

uh it may not be conducive to the message that the uh the employer is trying to get across to the public.

And again, getting back to your original question.

Employers retain a a great deal of discretion in these things.

However,

In certain scenarios, restrictions on on tattoos in the workplace

uh could constitute a violation of Title seven of the Civil Rights Act of nineteen sixty four and and could constitute a claim of religious discrimination.

Um there was a good example of this uh in a recent lawsuit that was uh filed by the Equal Employment Opportunity Commission uh against the Red Robin Gourmet Burger Chain.

And uh and I think that illustrates um, you know, a lot of the issues involved.

Again, it depends on the tattoo, but I'm gonna say uh working on your assumption uh that it's like a gang tattoo

That can be the basis that can be the basis not to hire somebody.
