I move the Planning Commission forward Leggie 2025-0041 Duval Property, specs 2025-0114, specs 2025-0015, and specs 2025-0116 to the Board of Supervisors with a recommendation for approval subject to the conditions of approval dated February 17, 2026, and based on the findings for approval provided as attachments one and two to the February 24, 2026 Planning Commission Public Hearing Staff Report, I further move that

we amend the existing structure conditions to allow for them to be moved at occupancy permit rather than grading permit.

I respect the concerns of the gentleman that spoke, and I know that the engineering of this property has been done in such a way that it does avoid all of the issues that he has brought up.

There are some springs up there, and in fact, there's a fellow that lives up there that gets his water from

a spring currently that runs over the former Clemmons property, Silviculture now is the name.

This is a unique property up there, all the properties that run across the trail.

It's fascinating from a geological standpoint that there is a shelf, essentially, in the northern part of this property along the Appalachian Trail that is flat enough for a house, and that shelf extends through the larger property.

You see where the word site is, and they have a building envelope up there where they can put a house and have a, they're not going to, and then further on down as you go out to Ravens Rock, same shelf exists where it's kind of flat,

and then you have the mountainside above and below it.

I would like to further comment for Deval's.

I wish we had a better system in place that allowed for a more administrative look at something like this rather than having to go through the legislative process for as long as it has been.

to build a road that's gonna probably cost less than the cost of going through the application process.

This is a wonderful piece of property.

I've spent a lot of time up there in the last year on this and other properties, on the neighboring properties and those below it on Simmental Lane and Ravens Rocks as well.

It's a wonderful community of people up there.

Hope the Duvalls fit in nicely and well, and it sounds like they've already got a friend.

The rest of the people up there are great and wonderful people.
