The argument is more just the traditional antitrust claim here, that by combining Paramount and Warner, you basically create a company that controls a third of basic cable programming and a third of theatrical film production, a company that is so large that it could theoretically raise the prices for consumers, harm their employees by lowering their wages, and overall reduce the quality of the product that goes out there to consumers.
Paramount, in a press release when this lawsuit was first filed, says that the attorneys general here have a basic misunderstanding and distort antitrust law.
And their argument, in a way, is that at this point, media is just controlled by giant companies.
And to the extent that anyone is concerned about competition, there are already these companies that are kind of big streamers that are pretty dominant.
Think of Netflix.
Think of Disney, which, of course, is ABC.
I was about to say, Disney Plus, our parent company.
Yeah.
And the argument basically here is if you want competition, you need to have companies that are big enough to compete in that space where you're going up against the Netflix, against the Disney Plus.
And by merging these two companies, yes, theoretically, there are less companies in the game, but you're creating an entity that has enough might to go up against these big companies.
So that's their overall argument here.
They're saying that ultimately this benefits competition in a way because you have another competitor to the really big
media companies.
So then what did the judge rule yesterday?
Because now this deal's on hold all of a sudden.
Why?
So in this ruling yesterday, the judge ultimately agreed with a lot of these concerns from the attorneys general.
It's a federal judge out of California concluding that there's compelling evidence here that this combined company will have substantial market share.
