We've been lucky in Cupertino so far that all these projects have included BMR units, whether inclusionary or non-inclusionary.

But it is possible that in the future a developer will say, hey, I want to pay an in lieu fee instead of including the BMR.

So we really need to have a nexus study that would determine what that in lieu fee would be because

it costs a tremendous amount of money for the land and the construction costs for these BMR units.

I mean, they could easily cost a million dollars each to build.

So I think we really need to start looking at figuring out what those in lieu fees should be.

So that would be another agenda item.

Maybe that's more of a council agenda item than a planning commission agenda item, or is it both?
