Chapter 1: What allegations are being made against Eric Swalwell?
California Congressman Eric Swalwell, now the fourth Democratic official to face mortgage fraud allegations, according to new reporting from NBC News. President Trump's top housing official, Bill Pulte, reportedly referred Swalwell, again according to NBC News, to the Justice Department for a possible federal criminal probe based on allegations of mortgage fraud and tax fraud related to a D.C.
residence, according to a person familiar with the referral who, again, spoke with NBC News.
I mean, that's basically the argument. Remember where this is coming from. This is coming from Bill Pulte, who runs the FHFA, Federal Housing Finance Authority, and somebody who is close to the president and has at times clashed with other people in the White House, but has this close relationship with the president.
And based on our reporting and public reporting, does a lot of what the president wants him to do. And listen, I don't know the particulars of Eric Swalwell's living situation. So this again, this letter, which I believe we do have, although I'm not entirely sure since I've been on with you. doesn't really lay out in rich detail what they are going after him for.
But to be honest with you, as Lisa just said, if you look at the list of people that the administration is targeting, it's all people who are political adversaries of the president. So we'll see where this goes. Eric Swalwell has made a name for himself up here on Capitol Hill as somebody who is probably one of the most ardent critics of the president going back years.
And the Trump world has gone at him with everything they have over the over the last few years as well. So, yeah, I am not surprised by this in any way, shape or form, to be frank with you.

The other bit of news as we watch what happens next with Eric Swalwell. And I am curious to see if Republican lawmakers start to get uncomfortable with this and maybe start to say so. Jake, you let me know if that starts happening. But I assume it hasn't happened yet.

Chapter 3: How does Swalwell respond to the mortgage fraud allegations?
Can I make one point here? Sure. I will. You hit a key point. which is a lot of members of Congress have homes in Washington, D.C. Many, many, many of them.
You're working in both places.
So if you're going to do something like this on the merits, and by the way, it ain't cheap, I'm just saying. It's a complicated living situation that costs a lot of money. I would imagine that a lot of people have a lot of, you know, people have mortgages in both places and stuff like that. I'm not familiar enough with the law to know whether what defines a primary residence.
He's a resident of California. Clearly, he's elected from California. But if you're going to start poking around at the living situations of 535 members of Congress, which, by the way, we have done in the past in my career looking at living situations, it is complicated.

Chapter 4: What legal implications could arise from Swalwell's situation?
Lisa, there was a court hearing about this today. That's why you're standing out there outside. Tell me what happened.
You know, Judge Cameron McCurry of the District of South Carolina, Katie, came up here to Alexandria, Virginia, to the courthouse right behind me to hear arguments from lawyers for Tish James and James Comey together about why Lindsay Halligan's appointment here was unlawful and why, in light of that, the indictments against both of them cannot stand.
Judge Curry is not a particularly demonstrative judge. She's not a person that you can really tell her moods based on her expressions, for example, or where she's headed. But she asked a couple of questions that indicate to people like me where this is going. And the first question out of her mouth, and this is in Politico's very good report of today's hearing.
was she asked the defense if they were in possession of what's called the declination memo that was written in the Comey case. A declination memo is sort of what it sounds like. It is a detailed legal memo laying out the reasoning why prosecutors believe that in the interest of justice, a case should not be brought. Now, Jim Comey's lawyers don't have that.
But Judge Curry is asking the question because the government's position here is if anything went wrong in the appointment of Lindsay Halligan,
nothing more than like a scrivener's error or a paper error and i think what judge curry is driving at is no no something here was very substantial something here was gained that otherwise would not have been you had line prosecutors authoring a declination memo maybe that's not in your possession now but we know it to exist and if they didn't want to bring the case
The very fact that Lindsay Halligan was appointed here and that Eric Siebert, who had been her predecessor, was forced to resign.

He and Jen Rubin over at their new Substack gig, The Contrarian, were hosting a pretty bizarre live stream where they were talking about specifically this strategy where they're bringing these lawsuits against these interim U.S. attorneys to try to force it to the judges to basically pick their replacements.
And they're fundraising off of that.

Yes. Yeah. But it's, I mean, fake money to begin with. Let's not get into the Act Blue stuff. But, yeah, all these lawsuits are basically cut from the same cloth in terms of the entities that they're coming from.
The viceroy is with us, Mike Davis. Mike, so Natalie's just told us who's doing this. They're fundraising off it. I mean, if you watch MSNBC, they're beating themselves on the chest at how great a strategy this is. Are they going to get Halligan? Are they going to get Halligan off this case, sir?
Well, even if they have some Democrat-appointed judge temporarily get her off this case, it will get appealed up through the appellate system to the Supreme Court, and I think the Supreme Court is going to side with the Trump Justice Department on this. She was appointed based upon a statute giving her a 120-day appointment, and then the Attorney General, Pam Bondi,
also made Halligan a special attorney to the attorney general. So she has full authority to do what she's doing.
Chapter 8: How do AI and genetic engineering intersect in modern research?
And they could just make her the first assistant U.S. attorney, and she can continue doing her job as the first assistant. Here's the bottom line. They may try to get some Democrat judge to temporarily knock these U.S. attorneys out of their positions, but it's not going to fix their problem.
If you look at what Halligan has done so far in response, for example, to Comey's motion to dismiss the indictment for selective prosecution, Halligan showed overwhelming evidence in response to that that Comey lied to Congress and obstructed the congressional investigation. She just put out more evidence today when Comey asked for a bill of particulars. This evidence is very damning.
against James Comey, and I can see why these Democrat activists are running to these Democrat judges to try to get rid of Halligan. But they're also trying, I want to make sure the audience understands that these filings are solid.
They're trying to make a case that there's really no evidence on Comey, and they didn't file anything, and the judges are upset, and they're asking again today, because they're trying to build a narrative that the Trump Justice Department is just a group of unprofessional savages, that run into court with indictments, but then don't have anything. They're not ready to go to trial.
They haven't done anything. What are the facts here, Mike, as you see them? The facts are that Lindsey Halligan working with Kash Patel and Dan Bongino and Senator Chuck Grassley's office have unearthed tremendous evidence of guilt against James Comey for lying about
The Russian collusion hoax, crossfire hurricane, lying about these ongoing investigations, obstructing congressional investigations. Lindsay has shown the receipts, and she's doing it the appropriate way. It's Comey who's inviting this. He's filing the motion to dismiss the indictment, the motion for a bill of particulars.
And in response to each one of those, Lindsay Halligan has shown her receipts. And again, this evidence is overwhelming and it's damning. Now, of course, he gets to go to trial. He can put on his own evidence. He can confront the evidence and the witnesses against him with cross-examination. He's presumed innocent, all of that.
But if you look at this evidence with his own emails, if we have a fair judge and a fair jury, Comey's going to prison. How long on Halligan? You broke up, Steve. I apologize. How long on Halligan before the judge comes to some conclusion? Is she on the case or not on the case? I think this judge is going to bounce Lindsey from the case because it's a Clinton-appointed Democrat judge.
And, of course, they know that Lindsey's over the target. And so they're going to do everything they can to stop her. They're going to try to create this smoke around her. She will eventually get put back on the case. I don't know if it's going to be the Fourth Circuit who does it. or the Supreme Court that does it, but Lindsey will be back on this case.
