So taking the Fifth is when you refuse to answer a question because your answer could incriminate you. I'm not going to answer this question because the answer I give could be used against me in a criminal case. The Fifth Amendment, part of the Fifth Amendment says, no person shall be compelled in any criminal case to be a witness against himself, among other things. That's the double jeopardy and stuff like that. I guess back in the day, people in England... were forced to incriminate themselves. And our founders said, no, no, no, no. People shouldn't be forced to do that. The government or the people, we the people, have to prove that you committed a crime, not just get you or force you to admit it.
So abuse of this back in the day would be the police or whoever would ask you all these broad questions.
