And then at the end of the public hearing, the Planning Commission, by law, specified that the Commission annually elect its officers. And the officers are the chair, the vice chair, secretary, and parliamentarian. And these are elected from our membership. And they're to be elected at the second meeting of each calendar year, which is tonight. So the Commission will undertake this annual task after the public hearing. yes sir thank you mr. chairman good evening everyone decision only that we have this evening and my district is for a business to have a special exception to continue their operation it's a tire business where they sell the tires there but they are asking to also do the installation on site and there's a unique about this property, where the front portion of it is commercial, zone commercial. The back half is zone residential. The community there. Although they support the business, they would like to see residential there. But I will be moving to approve tonight. And the reason for the deferral is that we wanted to have complete community engagement to make sure everyone and the voices were heard.
The New Gum Springs Community Association that's there, they had a meeting last night. The applicant made a presentation to the association and the members there. are in support of this application. The Mount Vernon Council, the applicant met with the council last Monday, the 5th, and the Mount Vernon Council also wrote a letter in support of this application, one of the things in the letter of support from the Mount Vernon Council is that you'll notice in the development conditions that this special exception is for five years. And within the five years, the Mount Vernon Council is asking that the land owner of this property begin the process of rezoning re-zoning the lot so that it could be ready for residential.
And talking with staff, and staff can clarify this for me, we can not mandate or have that type of condition within this development condition. The only thing we can do is continue to work with the application, which the application has certainly been supportive and been good stewards within the community. So I don't know if the staff have any more to share on that. Ms. Murray? Thank you. No, you hit it right on the head, Commissioner. We will just continue working with the applicant to help them through the process, but we can't have a development condition requiring them to rezone the property. Yes. Thank you, Ms. Mary. So, Mr. Chairman, otherwise, we have support from the community, and I am prepared to move a motion if
we're all ready. So I request that the applicant confirm for the record their agreement to the proposed development conditions consistent with those dated January 6, 2026.
Good evening, commissioners. My name is David Gill of WireGill here on behalf of the applicant, and we reaffirm our support of those conditions dated January 6th. And I'd just also like to state for the record that it is our intent to file with the next SSPA process a plan amendment to allow residential. We do need to go through a plan amendment first before we can proceed with rezoning it. So that is absolutely our intent, and I just want to make sure that was clear for the record.
