Um, juveniles will have to or excuse me, officers would need to seek a referral from the juvenile court counselor to get that secure custody order if the crime is a felony, if it involves gang activity or weapons, or if it involves an aggravated assault.
So if any juvenile committed one of those particular types of crimes, they could not be.
sent by the officer through a diversion program and the officer would seek that secure custody order with the juvenile court counselors.
Um let's say that it is an option for officers to divert.
They would do the police report to enter the facts and information of what occurred and then students send that juvenile through the diversion program.
Or else if it's a crime that is
It can be diverted, but based on that particular juvenile's history, the officer does not divert them.
That juvenile would then enter the juvenile court process by way of a petition.
Um, this is governed by chapter seven B of our North Carolina general statutes.
And would involve that child going to the eighth floor of the courthouse where a juvenile district court judge would hear that particular matter.
Um, it's important to state here that these charges would not automatically initiate a neglect case against that juvenile or their parent.
However, I will say that the juvenile court system takes a very global and holistic look at each juvenile.
And there could be any sort of crime before a juvenile court judge where that matter could end up in a case where the family has an open DSS investigation for abuse, neglect, or or any sort of thing, but it does not automatically flow from
A curfew charge or any particular charge.
Um, our officers, our juvenile court counselors, our district court judges all have a duty to report.
And if there were to be something in the factual circumstances of, for example, a curfew charge that required reporting to DSS, then that would open a file, but it is not an automatic part of the juvenile arrest process.
Um a big thing people think that when juveniles are arrested it means automatic handcuffs as this chief said that they are taken to the sheriff's office.
They are not generally speaking with the juvenile arrest, the parent or guardian of that juvenile is called to come and get them.
And from there, diversion and petition decisions are made about whether that case will go to court or be diverted.
Now, sometimes when detained, officers do have legal authority to use handcuffs on juveniles depending on the particular act committed on that date and other factual circumstances.
