Good morning, everybody. So the july fifteenth, twenty twenty six meeting of the Fairfax County Board of Zoning Appeals will please come to order. Are there any matters to be presented by members? No? If not, I'll review our procedures for those of you who have not been here before. Once your case is called, please step up front to the microphone and I'll ask that anyone wishing to speak to that particular case please stand, raise their right hand, and face the clerk on the left to take the oath. Once that's done, the applicant will be asked to state their name and address for the record and whether or not they reaffirm the affidavit as previously submitted. The applicant will then be asked to have a seat in the front row or listen remember.

Each individual speaker will be given up to three minutes in which to speak, and if you represent a citizens association, you will be given up to five minutes.

All right, with that said we've got some consent agenda items that we must call first before the public hearings portion of the agenda. So first we have Nicholas Otero SP dash twenty twenty four dash M V dash zero zero zero four five requesting a deferral till October the seventh, twenty twenty six. All right. Um and then we also have Rachel Lima and Jose Villa Corda Vienna, SP dash twenty twenty five dash BR dash zero zero one oh five case withdrawn. Any comments on these items?
No. Okay, then they are approved. as I just announced them. So we will now start the public hearing portion of the agenda. We have first AMA RE Holdings LLC SP dash twenty twenty five dash SP dash zero zero zero five nine. I understand there is a request for indefinite deferral. That that's correct. Yeah, there's some some late breaking news that happened just, you know, even after the update went out at three PM yesterday. The applicants um contacted me and indicated that they do in fact want to indefinitely defer um to take the time to to pursue a potential um either a proper interpretation, proper condition amendment. Staff has prepared a brief summary. I don't know if the board wants to hear that. The applicant's not gonna be in attendance today.
Um but the board wants to hear just a brief update. If you have a mem we have submitted a memo that has our findings, um includes the proffers and um original GDP from O five that that has you know created the issue that has come to light. Um so again we have a short presentation but uh it's up to the board if we want to go through that. If not, um again the request is for indefinite deferral, which staff of course obviously is recommending. Um up to the board. Um as my supervisor stated, at its June 10th, 2026 meeting, the board heard the uh SP 2025-SP 59, uh, which was filed by OMA RE Holdings to permit a reduction of setback requirements for two second-story editions.
