The June 3rd, 2026 meeting of the Fairfax County Board of Zoning Appeals will please come to order. Are there any matters to be presented by members? If not, I'll review our procedures for those of you who have not been here before. Once your case is called, please step up front to the microphone, and I'll ask anyone wishing to speak to that particular case, stand, raise their right hand, face the clerk on your left to take an oath. Once that's done, the applicant will be asked to state their name and address for the record and whether or not they reaffirmed the affidavit as previously submitted. The applicant will then be asked to have a seat in the front row while we get a location and report from staff.

Once we've heard the staff report, the applicant will be given up to 10 minutes to give their justification for whatever it is they're seeking today. We emphasize up to 10 minutes because we do have detailed staff reports which have the justification in them. But do feel free to add to that if you would like to do so. If there is anyone, I'll ask then if anyone wishes to speak to the application. If you've not already signed up to speak, please do so again at the left of the clerk's desk. If each individual speaker will have up to three minutes in which to speak. If you represent a citizen's association, you'll have up to five minutes. If there are no speakers in opposition, if there are speakers rather in opposition, the applicant or the applicant's agent will have five minutes of rebuttal time.

With that said, we have a couple of consent items to address before we get to the public hearings portion of the agenda. This morning, there are two matters on our consent agenda. If there was no issue with any of the members of the board, both the requesting indefinite deferral. And if there's no objection, we'll go ahead and move those items approved. So the first case we have this morning is the matter of Jesse R. Haborn and Mary Laurel Haborn. in SP 2025-SP-00149.

As he said, I am Megan Riley with the Department of Planning and Development. I'm here to present the following special permit application requesting a detached ALU. The subject property is a 2.2 acre roughly rectangular shaped interior lot located at 11501 Chapel Road in the Chapel Knolls subdivision in Clifton. The property is located approximately 600 feet west of the intersection of Chapel Road and Yates Ford Road on a lot that is predominantly open lawn with pasture areas and some mature trees and shrubs. The property and surrounding lots are currently zoned RC and WS and are planned for one to two dwelling units per acre.

When plotted originally, the property was zoned RE1 under the 1959 ordinance, then R1, and was subsequently rezoned to RC in 1982 as part of the Occoquan down zoning. As such, this law is considered legally non-conforming. The property is currently developed with a 3,566 square foot, two story, four bedroom, single family brick and vinyl sided dwelling constructed in 1969.
