Good morning. The May thirteenth, two thousand twenty six meeting of the Fairfax County Board of Zoning Appeals will please come to order. Are there any matters to be presented by members? If not, I'll review our procedures for those of you who have not been here before. Once your case is called, please step up front to the microphone and I'll ask that anyone wishing to speak to that particular case stand, raise their right hand, face the clerk on your left to take an oath. Once that's done, the applicant will be asked to state their name and address for the record and whether or not they reaffirm the affidavit as previously submitted. The applicant will then be asked to have a seat in the front row or while we get the location and a report from staff.
Once we've heard the staff report, the applicant will be given up to ten minutes to give their justification for whatever it is they are seeking today. I emphasize up to ten minutes because we have detailed staff reports which contain the justification in them, but feel free to add to that if you would like to do so. I'll then ask if there's anyone who would like to speak to the particular application. If you've not already signed up to speak with the clerk, please do so at the desk here on your left again. Each individual speaker will have up to three minutes in which to speak, but if you represent a citizens association, you'll be given up to five minutes. If there are any speakers If there's an opposition, the applicant or the applicant's agent will be given up to five minutes of rebuttal time.
Once you've spoken, you cannot come back to speak unless you're asked to do so by a member of this board. Um with that said we can go ahead and deal with um the consent items this morning before we call the public hearing portion of the agenda. And we have one uh matter Well, let me just check with staff real quick. Mr. Krasner, i i the uh the first case that's now requested a deferral. Well That would be handled as a motion since it's been advertised.

Very good. Okay. So we just have one request for deferral. Um Jonathan Haney, uh which is uh being deferred till uh July twenty second, two thousand twenty six. And if there are no objections to that, uh we can move That deferral approved. Okay. Um Our first matter is Helen. Googling me. In I don't see the uh the applicant here. So

the Well as as I again emailed the board yesterday, there was a change in this application. Brent Krasner, Department of Planning and Development. And again this is held in the Google ME, VC twenty twenty five MA zero zero zero zero two. Um The applicant contacted me yesterday and explained that um after reviewing the staff report addendum which is in your package which was published last Wednesday recommending denial of the most recent revised proposal. Um they have m reevaluated their their decisions and about how to proceed and have decided to pursue um approval f for the RPA um modification with the environmental review committee, which is a process that's again under the auspices of land development services.
Um and so they've decided to to do that first and and put this process on hold. So they're they're p they're what they're requesting is to put this variance on a definite deferral. Until such time as they decide to reactivate, presumably if they were successful, um at the Environmental Review Committee, they would then come back and reactivate this and we'd kind of restart the process, readvertise and and uh likely there would be changes to the proposal at that time. I d I don't know what those would be. Um but that's where we're at. I did recommend to the applicant that they could attend this morning to if there was any board questions. I got an email very late in the evening yesterday that They were the applicant was talking with the owner of the property and
still deciding, you know, what they were going to do, but so apparently they've not they've not attended. But I don't it doesn't prevent the board from acting to defer it. I do I did have a written email, you know, written written correspondence asking for the deferral.
