Good morning. The october fifteenth Two thousand twenty five meeting of the Fairfax County Board of Zoning Appeals will please come to order. Um are there any matters to be presented by members today? Um I'm going to appoint um uh a committee that'll to deal with uh a couple things, just the uh preparation for our annual report this year and then as well um coming up with a mission statement. Um for our board and What we would include in like a welcome packet for BCA members. So I think um You know, everybody can uh be on the board, but it's if you're not there there'll be no actions taken, it's more of discussion and then we can bring that to a board meeting for uh action or decision on what we'd like to implement.

Um but rather than taking um part of the public hearings, you know, taking the time. Um so I guess we'll uh meet the committee will meet next after next after the meeting next week, if that's okay. It shouldn't take that long, but okay. Um other than that, I'll go ahead and review our procedures for those of you who have not been here before. When your case is called if you would step up front to the microphone and then I will ask that anyone who wishes to speak to the particular case stand, face the clerk, raise their right hand and take an oath. Once that's done, the applicant will be asked to state their name and address for the record and whether or not they reaffirmed the affidavit as previously submitted.

The applicant will then be asked to have a seat in the front row right next to staff here, and um we will get a report of the location and details from staff. Once we've heard the staff report, the applicant will have up to ten minutes to provide their justification for whatever it is they're seeking today. It's uh tin limited to ten minutes because we do have the staff reports which contain the justification in them, initial justification, but feel free to add to that if you'd like to do so. I'll then ask if there's anyone who'd like to speak to the application. If um s you've not already signed up to speak, if you would please do so with the clerk on your left, on my right. Each individual speaker will be given up to th um three minutes in which to speak, but if you represent a citizens association, you'll have up to five minutes.

Once someone has spoken, they cannot do so again unless they're asked to by a member of this board. Um With that said that we have no administrative matters this morning. So we will move um to our first public hearing. Uh which is Ryan Jacob Human and Ryan's Rising Scholars L L C. Is the applicant here?

Uh I don't believe so. We we've already discussed with the applicant um the situation and um Right. So this is a request to def it's a request for deferral. It was advertised and so we do need a vote. Um and again for the record, Brent Krasner, Department of Planning and Development. Okay. This was a situation where leading up to the publication of the staff report we uncovered an unpermitted addition to the house um which hadn't previously been identified. Um and so it's gonna take some time for uh the applicant to pursue getting building permits and inspections and and typically that's been our Our policy when we uncover these types of things for uh you know in conjunction with the home daycare use is that they get that sorted out prior to any approval as opposed to something that we might allow them to work on after given the safety concerns in the house.

Um and so the applicant, again this is probab this is something that occurred prior to his purchase of the property, but he's gonna pursue um getting the proper permits and inspections for the the rear edition that was built um without without permits. Um and so we're giving him till January at this point that's kind of the target. We'll see as we get closer if he's ready. Um but for now, you know, we're we're looking at January twenty eighth, um, twenty twenty six for uh deferral bit.
