What are the opening procedures for the Fairfax County Board of Zoning Appeals meeting?
8th, 2025 meeting of the Fairfax County Board of Zoning Appeals will please come to order. Do we have any matters to be presented by members this morning? If not, I'll review our procedures for those of you who have not been here before. Once your case is called, if you would step up front please to the microphone and I will ask anyone who wishes to speak to that particular case to stand, raise your right hand, face the clerk, and take an oath. Once that's done, the applicant will be asked to state their name and address for the record and whether or not they reaffirm the affidavit as previously submitted. The applicant will then be asked to have a seat in the front row while we get the location and report from staff.
Once we've heard the staff report, the applicant will have up to 10 minutes to give their justification for whatever it is they're seeking today. And it's limited to 10 minutes because we do have detailed staff reports which contain the justification or initial justification in them. But do feel free to add to that if you'd like to do so. I will then ask if there is anyone who wishes to speak to the application. If you've not already signed up, please do so with the clerk at the desk here on your left. Each individual speaker. will be given up to three minutes in which to speak. If you represent a citizen's association, you will have up to five minutes. If there are any speakers in opposition to the application approval, the applicant will have five minutes of rebuttal time.
And once someone has spoken, you cannot come back and do so unless asked by a member of this board. With that said, we have a few administrative items. to go over before we call the public hearing section of the agenda. First, we have Christopher J. Enriquez and Kelsey A. Enriquez in SP 2025, SP 00063, which is being administratively moved to October 15th.
That's correct, Madam Chair. Brent Krasner, Department of Planning and Development. I believe this was just a scheduling conflict. So this will be ready to go. We're about to publish this report for next week. It'll be here on the 15th. Okay. Thank you.
Great. We have Rahan Bahida, or Bhatia, and Sheila Kane, NBC-2025-MA-00014. which is being administratively moved to the 22nd of October.
Yes, that's also correct.
This project needed just a small revision, which they've done. And so we're on track to make it to the 22nd. We'll be ready at that time. OK, great.
Our next matter, which has been withdrawn, is Lift Me Up. in ZAPL-2025-DR-00012.
Which cases were administratively moved to later dates and why?
So good on that. Okay, next we have Jonathan E. Haney in SP-2023-SP-00037, which is being administratively moved into November 19th, 2025.
That's correct. This one, as you can tell by the case number, I mean, it has some history. There may be other problems on the lot beyond chickens. And so DCC is investigating some other nonconformities that were uncovered. And so it's possible an error in building location may be added to this case in addition to what they're already under NOV for. So we wanted to provide a little bit more time for DCC to make that determination. And so one way or the other, we're going to bring it forward on the 19th. Um, because it's, it's, it's gone on for quite some time and I think it's ready to, to come to a hearing. So, um, but that's the reason for this delay. Um, it took many, took a long time to get accepted since it's been accepted.
This is the first move, but, um, when the, when the report's published, it'll, it'll lay out the history.
Okay. Great. Thank you. Thank you. Okay. And finally, we have Olga Paradint, let's see, Paradiri. and Kiddie's Learning Academy, LLC, in SP 2025-BR-00019 being administratively moved to October 29th.
Yes, that is correct. This is the case I referred to in the email the other day that there was an advertising defect that we just uncovered. on Thursday that it appears that the notices were not sent to the proper addresses. So we unfortunately caught that too late to make any changes for today. But we're re-advertising it correctly, and it'll be ready on the 29th.
